TERMS OF SERVICE
These terms govern the use of AI Safety Check, an online service of Aisthetic Lab (see Impressum for details). They are written for business customers (Unternehmer) and are a working draft: have them reviewed for your specific situation before relying on them as a final contract.
For businesses only. Not available to consumers. The service is offered exclusively to businesses acting in the course of their commercial or professional activity (Unternehmer, § 14 BGB). Because consumers are excluded, statutory consumer protections do not apply — in particular the 14-day right of withdrawal for distance contracts and the special requirements for consumer payment buttons.
These terms apply to all services provided through AI Safety Check: the free AI readiness check, the team training, the AI Safety Passport and the Business plan. A contract is formed when the customer completes registration and the provider confirms access, or by written confirmation of an order. By registering, the customer confirms that it is acting in the course of its business and not as a consumer.
The service provides: (a) online training modules on AI use in a business context; (b) module tests with a 70% pass threshold and documented completion records; (c) a tool registry and incident log as software features; (d) an audit package as a PDF export. The content reflects the provider's understanding of the EU AI Act, the GDPR and German trade-secret law at the time of publication, and is updated as the legal situation develops.
Scope of the tiers: Training only grants access to the training and its completion records for the number of employee seats ordered (minimum five). Passport S / M / L grant the training plus the tool registry, the incident log and the audit package for teams of 1–10, 11–50 and 51–250 employees respectively. Business is an add-on that requires an active Passport and provides the quarterly legal review, template updates and priority support. Done-for-you is a one-off service: a customised AI usage policy, a recorded team training session and written Q&A support.
The service, including any generated AI usage policy, is a template and documentation tool. It is not legal advice and does not establish a lawyer–client relationship. The provider does not guarantee that use of the service achieves compliance with any particular legal requirement, and does not represent that the customer is "certified" by any authority. For binding legal assessment, the customer should consult a qualified lawyer.
Prices are stated in euro (€). The provider applies the German small-business rule (Kleinunternehmerregelung, § 19 UStG): while the turnover limits of that rule are met (€25,000 in the previous calendar year and €100,000 in the current calendar year), no value added tax is charged. Invoices therefore show no VAT and carry the note "Gemäß § 19 UStG wird keine Umsatzsteuer berechnet." The prices shown are the amounts payable. The team training is billed per employee seat (minimum five seats); the AI Safety Passport is a one-time licence for the number of employees in the selected tier; the Business add-on is billed monthly or annually; Done-for-you is billed once. Current tiers: Training only €19 per employee (minimum 5 seats); AI Safety Passport S €290 (1–10 employees), M €590 (11–50 employees), L €1,190 (51–250 employees); for 251 employees and above the price is set by individual quote (Passport XL). Business €39 per month or €390 per year. Done-for-you from €790. Prices may be adjusted for new orders with reasonable prior notice; already-paid plans keep the agreed price.
Payment is by invoice, not by online checkout. There is no card payment and no payment button: registration is a request for access, and the provider issues an invoice by email. Payment terms are 14 days net unless agreed otherwise; access is activated once the invoice has been settled, and the provider may suspend access while invoices are overdue. If the provider later exceeds the turnover limits of the small-business rule or opts for regular VAT treatment, prices become net plus statutory VAT from that point onward and the applicable VAT rules — including reverse charge for business customers in other EU member states who provide a valid VAT identification number — apply. Customers with a VAT identification number may state it on request so that it can appear on the invoice; cross-border treatment for customers in other EU member states should be confirmed with the customer's tax adviser.
The customer is responsible for the accuracy of the information it enters (company details, tools, incidents) and for ensuring that its employees may participate in the training. Where the customer processes personal data of its employees in the service, it is the controller and a data processing agreement is concluded (see AVV / DPA).
The provider aims for high availability but does not guarantee uninterrupted service. Training content is updated when the legal or technical situation changes; the provider may add, adapt or retire modules. Where a change materially reduces the agreed scope, the customer may terminate the affected subscription.
The provider is liable without limitation for intent and gross negligence, and for injury to life, body or health. For simple negligence, liability is limited to foreseeable damage typical for this type of contract. Liability for the content of a customer's own AI policy, or for the customer's use of it, rests with the customer. This limitation does not apply where liability is mandatory by law.
One-time plans (Training only, Passport S / M / L): the licence is perpetual, and platform access is guaranteed for 12 months from purchase — it can be extended, and after the access period the records (audit package, completion records) remain exportable on request at any time. Subscriptions (Business) renew automatically for the same period and may be cancelled at any time with effect from the end of the current billing period; no notice period applies.
Business add-on: consistent with the rule above, the customer may cancel at any time with effect from the end of the current billing period. Where the annual price (€390) has been paid, the subscription runs to the end of the prepaid year and is not refunded pro rata. After cancellation, nothing is deleted automatically: the Passport, the training records and the audit package remain the customer's and stay accessible for at least 12 months, exportable at any time.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For merchants, legal persons under public law and special funds under public law, the place of jurisdiction is the provider's registered seat. Mandatory consumer protection provisions remain unaffected.
